1. ACCEPTANCE OF THE USE OF LINE49 LLC WEBSITE TERMS AND CONDITIONS

Your access to and use of the LINE49 LLC website is subject exclusively to these Terms and Conditions. You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the website, you fully accept the terms, conditions and disclaimers contained herein. If you do not accept these Terms and Conditions, you must immediately stop using the website.

2.  CREDIT CARD DETAILS

Valid credit card information must be provided at the time of order. Payment is processed immediately upon order placement unless otherwise stated. Credit card processing fees of 3% apply to all wholesale/dealer orders paid via MasterCard or VISA. (ACH available with no fee.)

3.  ADVICE

The contents of the LINE49 LLC website does not constitute advice and should not be relied upon in making, or refraining from making, any decision.

4.  CHANGE OF USE

LINE49 LLC reserves the right to:

• 4.1 Change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that LINE49 LLC shall not be liable to you for any such change or removal.
• 4.2 Change these Terms and Conditions at any time, and your continued use of the website following any changes shall be deemed to be your acceptance of such change.

5.  LINKS TO THIRD PARTY WEBSITES

The LINE49 LLC website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that LINE49 LLC is not responsible for the content or availability of any such sites.

6.  COPYRIGHT

• 6.1 All copyright, trademarks, and all other intellectual property rights in the website and its content (including without limitation the website design, text, graphics and all software and source codes connected with the website) are owned by or licensed to LINE49 LLC or otherwise used by LINE49 LLC as permitted by law.
• 6.2 In accessing the website, you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder, except for personal, non-commercial home use.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

• 7.1 The website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including, but not limited to, the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
• 7.2 To the extent permitted by law, LINE49 LLC will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the website.
• 7.3 LINE49 LLC makes no warranty that the functionality of the website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
• 7.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of LINE49 LLC for death or personal injury as a result of the negligence of LINE49 LLC or that of its employees or agents.

8.  WARRANTY

All LINE49 LLC products are warrantied against all manufacture defect(s). LINE49 LLC products are not covered under warranty from issues or damage caused by operator error or negligence. For 3rd party products, we do not refer our customers directly to 3rd party manufacturers for warranty. We prefer to handle all claims, "in house". In extreme cases we will replace the warrantied item ourselves and then claim it back from the manufacturer at a later date. We will also cannibalize parts from new in-stock products if necessary to expedite claims. Under no circumstances attempt to return products direct to a manufacturer without first consulting with us. With all claims we need a copy of your sales receipt or the order number.

9.  RETURN & REPAIR POLICY

All custom or “made to order” work completed by LINE49 LLC is considered a final sale and non-returnable. Unused, unopened, standard products may be returned within 30 days of delivery. Returns must include original packaging and proof of purchase. A 25% restocking fee applies to all returns. Shipping charges are non-refundable, and return shipping is the customer’s responsibility, unless the return is due to our error or a defective item. All returns and warranty repairs require prior authorization. Unauthorized returns will be refused. Any returns received without an RMA (Return Materials Authorization) number will be returned to the sender unopened. Contact info@L49R.com, or call 406-955-2434 to obtain RMA. 

10. ORDER CANCELLATIONS

All requests for an order cancellation must be submitted via info@L49R.com, or call 406-955-2434. If production or shipment has already begun, cancellation may be subject to restocking fee to cover incurred costs.

11. WEBSITE TERMS

LINE49 LLC does their best to accurately describe and represent all products, however, errors may occur. Prices are subject to change at any time. LINE49 LLC reserves the right to edit, change, or clarify descriptions at any time to correct errors in product listings. Please be aware items that are incorrectly listed or priced and subsequently ordered may be cancelled at our discretion. In the event of a conflict in the description of an item, we reserve the right to remove the conflicting information once notified.  We make no warranty on the accuracy of a product listing when a conflict in the product information is present. Photos shown are not of the actual item being shipped and may show options not included in the item being sold.  Photos are provided for general identification purposes only and may show optional or additional pieces for illustration purposes.  

12. FIREARM PURCHASES

LINE49 LLC ships firearms direct to valid FFL dealers only. PRIOR TO ORDERING: Please contact your local FFL dealer receiving the firearm to verify their transfer fee and to ensure they will receive your transfer. If you order a firearm, YOU MUST be a legal resident of the state in which you are ordering and be at least 21 years of age to complete the transfer through your FFL*. Contact your local FFL dealer with any questions regarding the sale or transfer of firearms. The customer is responsible for knowing his/her state laws regarding firearm transfers. The customer assumes all responsibility and cost for returned firearms due to FFL refusal or failure to receive. 

*Exceptions – Military personnel stationed in a state other than their legal residence may purchase firearms across state lines. Contact your local FFL receiving the transfer as you may have to provide proof of deployment, residence, etc.

13. MAGAZINE PURCHASES

LINE49 LLC abides by all state, federal, and local laws regarding magazines. If a magazine that exceeds your state’s legal limit is ordered, the magazine will be removed, refunded, or replaced with a compliant model at LINE49 LLC’s discretion. LINE49 LLC applies the laws for civilian magazine purchases to all non-governmental magazine purchases within a state. The customer is ultimately responsible for understanding and complying with applicable laws.

14. LEAD TIMES

LINE49 LLC lead times are estimates and we make every attempt to ship within the time specified. If a lead time is not specified, the product is expected to ship within 30 days.

15. SHIPPING

• 15.1 All orders ship signature required, shipping insurance is optional. More details are accessible via the Orders & Shipping page.
• 15.2 Items which are expected to take longer than 30 days to ship will be listed as such on their product page along with an estimated lead time. If orders take longer than originally quoted, an option for a refund can be requested.  
• 15.3 LINE49 LLC does not drop ship.

16. INDEMNITY

You agree to indemnify and hold LINE49 LLC and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs, and other expenses in relation to any claims or actions brought against LINE49 LLC arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.

17. SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed, and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

18. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Montana, United States of America, without regard to conflict-of-law-principals. Any disputes arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Montana. If you are accessing this website from outside the United States, you are responsible for compliance with your local laws and regulations.
